OSHA Violations

All employees have the right to work in a workplace that is safe and that does not jeopardize their health in anyway.  Employers have the responsibility of ensuring that their employees work in environments that are safe, that do not compromise their employees' health, and that adequately forewarn their employees of potential dangers. 

In 1970, the Occupational Safety and Health Act (OSHA) was passed by legislatures to ensure that employees worked in safe, healthy workplaces.  OSHA was created and passed to protect the health and well-being of workers.  Additionally, OSHA was passed so that employers would have to follow and comply with set health and safety regulations.  These regulations provide standards for employers and demand that employers not only provide safe work environments for their employees, but also take immediate corrective measures when an unsafe work condition is reported or is noticed. 

When employers do not follow the regulations set forth by the Occupational Safety and Health Act, they are committing an OSHA violation, and may be subject to legal action.  In today's work environments, common OSHA violations include, but are not limited to:

  • violation of control of hazardous energy
  • violation of chemical safety   
  • violation of machine requirements
  • violation of respiratory protection
  • violation of mechanical power transmission apparatus
  • violation of electrical systems

After an employee notices that his/her employee has committed an OSHA violation, he/she may report this violation, and the employer will have to implement corrective measures so that he/she is in accordance with OSHA.  Anytime an employer does not implement measure to be in accordance with OSHA, he/she may be subject to immediate legal action.
