Unsafe Workplace

According to California law, all employers are responsible for providing their employees with a workplace that is not only safe, but also conducive to protecting the employees' health.  Employers are liable for the conditions in which their employees must work and should always do everything they can to safeguard their employees while they are within the workplace.  When an employer fails to protect the safety and health of their employees, the employer is making the employees work within an unsafe workplace, which is illegal.

When employees recognize that they are working in an unsafe workplace, they may choose to report their employers if the employers fail to take measures to correct the unsafe conditions.  It is well within an employee's rights to report unsafe conditions and to ask for his/her employer to implement corrective measures.  Unfortunately, instead of addressing and fixing unsafe workplace conditions reported by an employee, an employer may choose to discharge the employee instead.  Often times, employers see this as an easier option, and fail to realize that they are violating the California Labor Code.
 
According to the California Labor Code, employers cannot discharge, terminate, threaten to terminate, layoff, or discriminate against an employee who reports unsafe workplace conditions.  Employees have the right to make oral or written complaints when they notice problems within their work environments and should never be subjected to retaliation by their employer for making complaints.  Additionally, employees who are subjected to retaliation by employers have the right to take legal action against their employers, and recover damages for any pain, suffering, or lost wages they may have incurred.
