Worker's Compensation Claims

Everyday, workers face dangers within the workplace.   Usually, these dangers can be avoided.  However, there are times when workers are either unaware of hazardous conditions or cannot avoid the hazardous conditions, and sustain work related injuries while on the job.  When an employee is injured on the job, he/she may need time to recover from his/her injuries.  This recovery time may be temporary or, in some tragic cases, permanent.  Thankfully, the law allows workers to focus on healing and recovering from their injuries without having to worry about their financial security by providing workers with monetary compensation, known as worker's compensation.

After a worker has sustained a work related injury, he/she can file a worker's compensation claim.  Once a worker's compensation claim is filed and approved, the worker's employer will pay benefits to the worker while he/she is recovering.  These benefits usually last for a set period of time and can be extended in certain situations.  This form of compensation is greatly appreciated by employees who can no longer work as they still need a way to support them selves, support their families, and also pay for medical care they may be receiving.

Sadly, there are cases where employers deny injured employees worker's compensation.  In some cases, the employee may not be eligible for benefits.  And, unfortunately, there are cases where employers deny benefits to employees for illegitimate reasons.  In the later instances, it is always in the employee's best interest to consult with a knowledgeable employment law attorney who is familiar with the laws surrounding worker's compensation claims and 132a claims.

132a Claims

A 132a claim is a type of claim that is filed by an employee who feels that his/her employer has discriminated against him/her because he/she has filed a worker's compensation claim due to being injured on the job.  When a worker is subjected to discrimination from their employer, and he/she wishes to file a 132a claim, it is a good idea for the worker to consult with a lawyer who has experience with both worker's compensation claims and wrongful termination cases, like the attorneys at Employment Lawyer's Group.
